I believe that SSD features will follow the uEFI pre-OS driver.

So: 1. How do I ensure Intel's driver is used and not Gigabytes

2: or are all features available from NVMe boot + Intel NVMe operating system driver?

This option may or may not be available to you depending on the motherboard you have. Look for options like Option Rom or O-ROM.
